Terms and Conditions
1. Scope
These Terms and Conditions (T&C) apply to all contracts between Bewaer (hereinafter referred to as the "Provider") and its customers (businesses and consumers) concerning the production and delivery of custom-made textile products.

2. Subject of the Contract
The Provider manufactures textile products according to customer specifications. A contract is established upon the Provider’s written confirmation of the order.

3. Order Process & Production Workflow

The customer submits an inquiry with their requirements.

After consultation, a paid sample is created.

Upon approval of the sample, production of the full order begins.

Once production is completed, the goods are shipped to the customer.

4. Minimum Order Quantities & Production Surplus
The minimum order quantity (MOQ) varies between 50 and 70 pieces, depending on the product category. Due to production processes, a surplus may occur, which must be accepted by the customer. For orders under 100 pieces, the surplus is a maximum of 10–20 pieces, and for orders up to 1,000 pieces, a maximum of 50 pieces. Since we work with full textile rolls, some surplus is unavoidable; however, we always strive to keep it as low as possible.

5. Prices & Payment Terms

Samples: Payment must be made in advance.

Full order: 50% of the total price must be paid before production starts, and the remaining 50% after production is completed.

The goods will only be shipped after full payment has been received.

6. Delivery Times
Delivery times depend on the order volume, material availability, and production complexity. They cannot be guaranteed.
7. Liability for Defects & Cancellation

Any refunds in monetary form in relation to production defects are expressly excluded, as all materials required for production have been procured and irreversibly processed.

In the event of production defects that do not materially impair the overall merchantability or resale value of the goods, the Customer shall have no right to claim replacement, compensation, or any form of reimbursement.

Any re-production of defective goods shall be subject solely to the Provider’s absolute discretion and contingent upon available production capacity. The Customer shall have no entitlement to such re-production under any circumstances.

Where the goods remain commercially sellable despite any defects, the Provider may, at its sole and exclusive discretion, offer a goodwill discount on a future order. No legal claim or entitlement shall arise from such goodwill arrangements.
8. Limitation of Liability
The Provider is not liable for production delays caused by force majeure, material shortages, or external logistics issues.
9. Jurisdiction & Applicable Law
Turkish law shall apply.
No Right of Withdrawal for Customized Goods
Since the products are made according to individual customer specifications, there is no right of withdrawal under the following regulations:

Article 16(c) and (e) of the EU Consumer Rights Directive (2011/83/EU)

The UN Convention on Contracts for the International Sale of Goods (CISG) does not generally apply to custom-made products
Legal Basis:

Under German law (§ 312g (2) No. 1 BGB), there is no right of withdrawal for goods made to customer specifications or clearly tailored to personal needs.

According to the EU Consumer Rights Directive (2011/83/EU, Article 16(c) and (e)), customized or personalized goods are also excluded from the right of withdrawal.

The UN Convention on Contracts for the International Sale of Goods (CISG) does not explicitly regulate the right of withdrawal, meaning national laws apply.
A withdrawal from the contract after order confirmation and production start is excluded.
